This Privacy Policy covers the collection, use and disclosure of information collected by xMatters, Inc. (“xMatters,” “we,” “us,” “our”) through the xMatters website (www.xmatters.com) and the xMatters customer portal. It also describes the choices available to you regarding our use of your personal information and how you can access and update this information. The use of information collected through our service shall be limited to the purpose of providing the xMatters service to our clients.   xMatters has received TRUSTe’s Privacy Seal signifying that this privacy statement and our practices have been reviewed for compliance with the TRUSTe program viewable on the validation page available by clicking the TRUSTe seal. The TRUSTe program covers only information that is collected through this Web site, www.xmatters.com as well as our customer portal and does not cover information that may be collected through downloadable software available on our site.   If you have an unresolved privacy or data use concern that we have not addressed satisfactorily, please contact TRUSTe here.

Collection and Use of Information on the xMatters Web Site

We may collect the following personal information from users who visit our web site:

xMatters collects information under the direction of its Clients, and has no direct relationship with the individuals whose personal data it processes. xMatters works with its Clients to help them provide notice to their customers concerning the purpose for which personal information is collected.

  • Contact Information such as name, email address, mailing address, phone number
  • Unique Identifiers such as user name and password
  • Information about your business such as company name and business type

We use this information to:

  • Submit notifications, emergency warnings and updates to individuals on the behalf of our Clients

xMatters will retain personal data we process on behalf of our Clients for as long as needed to provide services to our Client. xMatters will retain and use this personal information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.  

Disclosure of Information

We will share your personal information with third parties only in the ways that are described in this privacy statement.  We do not sell your personal information to third parties.  

Service Providers and Sub-Processors

We may provide your personal information to companies that provide services to help us with our business activities such as submitting promotional email communications and emergency alerts to you on the behalf of xMatters. These companies are authorized to use your personal information only as necessary to provide these services to us.   xMatters may transfer personal information to companies that help us provide our service to our Clients. Transfers to subsequent third parties are covered by the provisions in this Policy regarding notice and choice and the service agreements with our Clients.

We may also disclose your personal information:

  • As required by law, such as to comply with a subpoena, or similar legal process
  • When we believe in good faith that disclosure is necessary to protect our rights, protect your safety or the safety of others, investigate fraud, or respond to a government request,

Access to Information and Choice

Data Controlled by xMatters

If your personal information changes, or if you no longer desire our service, you may correct, update, amend, delete, or ask to have it removed from a public forum, or testimonial on our site by making the change within your account settings or by contacting us via one of the methods listed below.  We will respond to your request to access within 30 days.  

Data Controlled by our Clients

xMatters has no direct relationship with the individuals whose personal data it processes. An individual who seeks access, or who seeks to correct, amend, or delete inaccurate data should direct his query to the xMatters Client (the data controller). If the Client requests xMatters to remove the data, we will respond to their request within 30 business days.   Opt-out Preferences   Out of respect for your privacy, you may choose to stop receiving our marketing emails by following the unsubscribe instructions included in these emails, accessing the email preferences in your account settings page or by contacting us via one of the methods listed below.  

Security

The security of your personal information and our Clients’ information is important to us.  When you enter sensitive information (such as login credentials) we encrypt the transmission of that information using secure socket layer technology (SSL).   We follow generally accepted standards to protect the personal information submitted to us, both during transmission and once we receive it.  No method of transmission over the Internet, or method of electronic storage, is 100% secure, however.  Therefore, we cannot guarantee its absolute security. Tracking Technologies

Technologies such as: cookies, beacons, tags and scripts are used by xMatters and our marketing partners, affiliates, analytics or service providers. These technologies are used in analyzing trends, administering the site, tracking users’ movements around the site and to gather demographic information about our user base as a whole. We may receive reports based on the use of these technologies by these companies on an individual as well as aggregated basis. If you choose to use our referral service to tell a friend about our site, we will ask you for your friend’s name and email address.  We will automatically send your friend a one-time email inviting him or her to visit the site.  xMatters does not store this information for additional purposes.

Our Web site includes Social Media Features, such as the Facebook button and Widgets, such as the Share this button or interactive mini-programs that run on our site.
